1. About these terms
These terms apply when you use business-newswire.co.uk (the website) and when you buy or use any Business Newswire service, including press release distribution, writing, media outreach, monthly PR, brand monitoring and white label distribution (the services).
In these terms, we, us and our mean Business Newswire. You means the person or business using the website or services. By using the website or placing an order, you agree to these terms.
Our services are intended for businesses, organisations and professionals, not for consumers acting outside their trade.
2. Our services
Each plan and service is described on our pricing page and service pages. Accounts, orders, payments and support are handled on our distribution platform, which you reach from the forms on this website.
We will provide the services with reasonable care and skill, and within the timescales described for your plan. Distribution is usually completed within 24 hours of approval. Premium outlets apply their own checks and can take longer to publish.
3. Your account
- You must be 18 or over and give accurate details when you create an account.
- Keep your login details secure. You are responsible for activity on your account.
- Tell us straight away if you think someone else has used your account.
4. Your content and responsibilities
You are responsible for everything you submit, including text, images, links and quotes. You confirm that your content:
- is accurate, and any claims can be supported with evidence;
- does not defame anyone, breach confidence or infringe anyone’s copyright, trade marks or other rights;
- complies with UK law, including consumer protection law, the UK Code of Non-broadcast Advertising (CAP Code) where it applies, and UK data protection law for any personal data it contains;
- does not include a financial promotion unless it has been approved as the Financial Services and Markets Act 2000 requires;
- has the permission of anyone who is quoted or pictured.
Regulated disclosures. Our services are not a Primary Information Provider. If your company is listed and must announce inside information or other regulatory news, use a regulatory news service approved for that purpose. You can then use us to reach a wider audience.
5. Editorial review and publication
We review every release before it is distributed. We may ask you to change a release, or refuse it, if it breaks these terms, the law or an outlet’s rules. We may remove content that we later find to be in breach.
Publication on the sites included in your plan is what we provide. We cannot promise that a journalist will write an original story, that a search engine will show your release, or that an outlet will keep a page online indefinitely. Premium outlet links are kept live for 12 months where your plan says so.
6. Prices and payment
Prices on this website are shown in pounds sterling. Any VAT or other tax due is shown at checkout before you pay. You pay in advance for each release or service, or monthly for monthly services.
We may change our prices for future orders. The price you agreed at checkout applies to that order.
7. Cancellations and refunds
- If a paid release is not published on the sites included in your plan, you can have your money back.
- You can cancel an order at no charge before your release has been submitted for distribution.
- Monthly services can be cancelled at any time and stop at the end of the period you have paid for.
- Once a release has been published, the distribution service is complete and is not refundable, except where the law says otherwise.
8. Intellectual property
You keep ownership of your content. You give us, and the outlets in your plan, a non-exclusive, worldwide, royalty-free licence to copy, publish, format and distribute it for the purpose of providing the services.
The website, its design and our own text and graphics belong to us or our licensors. You may not copy them for commercial use without our written permission.
9. Our liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law of England and Wales.
Subject to that, we are not liable for any loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss. Our total liability for any claim relating to a service is limited to the amount you paid for that service in the 12 months before the claim arose.
10. Third-party sites
The outlets that publish releases are independent third parties with their own terms, editorial rules and technical systems. We are not responsible for their content, availability or decisions, including if an outlet removes or edits a page.
11. Suspending or ending the services
We may suspend or close an account that breaches these terms, including one used to distribute unlawful, misleading or harmful content. You may stop using the services at any time.
12. Changes to these terms
We may update these terms from time to time. The version on this page applies from the date shown at the top. If a change materially affects an order you have already paid for, the terms in force when you placed it will apply to that order.
13. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
